1. Introduction and Scope

These Terms and Conditions ("Agreement") form a binding legal contract between you ("User", "you") and Cameralux ("Company", "we", "us", or "our") that governs your access to and use of the Cameralux platform along with all its services, websites, apps, and features (collectively, the "Platform").

The Platform is a worldwide digital service connecting Users, including watchers, performers, and third-party participants through live streams, chat, and related offerings.

To clarify, this Agreement applies to all Platform Users regardless of location and covers all usage whether as a guest or a registered member.

2. Definitions

For the purposes of this Agreement, the terms below are defined as follows:

• "Platform" refers to the Cameralux website, apps, and all linked services.
• "User" means any person or entity accessing or using the Platform.
• "Performer" refers to any User who streams, uploads, or shares content via the Platform.
• "Studio" denotes any individual or organisation managing or assisting Performers.
• "Content" means any media, including video, audio, text, images, or interactions transmitted on the Platform.
• "Services" encompass all features offered by the Platform, such as live streaming, messaging, and payment systems.

These definitions are broadly interpreted to ensure enforceability and compliance with relevant laws.

3. Acceptance of Terms

By accessing, signing up for, or using the Platform, you confirm that you have read, understood, and agree to be bound by this Agreement.

If you disagree with any part of this Agreement, you must stop using the Platform immediately.

Your continued use signifies ongoing acceptance of this Agreement, including any updates or changes.

4. Nature of the Platform

The Platform functions purely as a tech service enabling interactions between Users. The Company neither produces nor controls user-generated content.

To be clear, the Company is not:

• An employer of Performers or Studios;
• A creator of content;
• An agent or representative of Users;
• A party to transactions between Users.

All content and interactions are independently generated by Users, who alone are responsible for their behaviour and legal compliance.

5. Eligibility and Age Requirements

The Platform is strictly for individuals 18 years or older, or of legal adult age in their jurisdiction, whichever is greater.

By using the Platform, you confirm you meet these age requirements.

The Company reserves the right to verify your age and identity and may restrict or end access if these conditions are not met.

6. Account Registration and Security

You may need to create an account to access certain Platform features.

You agree to provide true, complete, and current info during registration and to keep your login details confidential.

You’re responsible for all actions on your account and must notify the Company immediately of any unauthorised use.

7. Global Use and Jurisdiction

The Platform is accessible worldwide; however, it’s your responsibility to ensure your use complies with local laws.

The Company does not guarantee the Platform’s legality or suitability in every location.

Where local laws mandate certain requirements, those laws will apply without impacting the rest of this Agreement.

8. Modifications to the Agreement

The Company can update this Agreement anytime. Changes take effect once posted on the Platform.

You’re responsible for reviewing updates. Continued use means you accept the changes.

9. Termination of Access

The Company may suspend, limit, or end your access at its sole discretion, especially for breaches of this Agreement or the law.

Termination can happen without notice if necessary to protect the Platform or Users.

You may stop using the Platform at any time to terminate your access.

10. Relationship of the Parties

This Agreement does not create any partnership, joint venture, employment, or agency relationship between you and the Company.

You act independently and are fully responsible for your Platform activities.

11. Account Creation and Access

Some Platform features require a registered account. You agree to provide accurate and updated information and to keep it current.

The Company may reject, suspend, or close accounts with false or incomplete info.

12. Account Security and Responsibility

You alone are responsible for keeping your account details secure.

All actions taken through your account are considered your responsibility.

Notify the Company immediately of any unauthorized use or security breaches.

The Company is not liable for losses from your failure to protect your credentials.

13. Multiple Accounts and Restrictions

The Company may limit or ban multiple accounts by the same User if used to evade rules, payments, or enforcement.

Accounts reasonably linked to the same person or entity may be merged, suspended, or terminated.

14. Verification and Identity Checks

The Company may require identity and age verification to access certain services.

Failure to verify may lead to restricted or terminated accounts.

You agree to provide genuine docs when requested.

15. Account Suspension and Restriction

The Company can suspend or limit accounts where:

• Agreement violations are suspected;
• Fraud or suspicious activity is detected;
• Verification is incomplete;
• Legal requirements demand it.

Actions may be temporary or permanent and done without notice if needed to protect the Platform.

16. Account Termination

The Company may terminate accounts for breaches or payment problems.

You may close your account anytime by stopping use and requesting closure.

Termination doesn’t relieve obligations accrued before closure.

17. Access Limitations

The Company may limit access based on location, legal rules, or risk.

It’s not liable if you can’t access the Platform due to such limits.

18. Technical Requirements and Availability

You need compatible gear, internet, and software to use the Platform.

The Company doesn’t guarantee uninterrupted service and may do maintenance or updates affecting availability.

It’s not responsible for outages beyond its control.

19. Users (Viewers) — General Role

Users accessing the Platform to watch, chat with Performers, or use communication tools ("Viewers") agree to follow this Agreement and laws.

Viewers don’t create or manage content but can interact with Performers via live shows, chat, tips, and other features.

All User interactions are independent; the Company isn’t liable for User behaviour.

20. Acceptable Use and Conduct

You agree to use the Platform lawfully, respectfully, and responsibly.

The following are banned:

• Harassment, threats, or abuse of any User;
• Soliciting or promoting illegal or banned content;
• Trying to exploit or coerce Performers;
• Breaking laws or Platform rules;
• Interfering with Platform operations or security.

Violations may lead to swift enforcement action.

21. Prohibited Requests and Interactions

You must not request, encourage, or engage in content or actions that:

• Involve minors or underage individuals;
• Break laws or regulations;
• Violate intellectual property;
• Include non-consensual or abusive acts;
• Attempt to bypass Platform controls.

Such actions can cause immediate suspension and legal reporting.

22. User Financial Interactions

You may buy credits or pay to access content, interact with Performers, or unlock premium features.

All payments are voluntary and done through Platform systems.

Note:

• Payments don't grant ownership of content or Performers;
• No guaranteed outcomes or experiences;
• You must check transaction details before payment.

The Company isn’t responsible for disputes from your expectations.

23. Off-Platform Conduct and Circumvention

You must not move interactions, payments, or chats outside the Platform to dodge fees or rules.

This includes:

• Asking Performers for outside contact;
• Offering or accepting payments off-platform;
• Trying to bypass Platform protections.

Such acts breach this Agreement and may lead to immediate account termination.

24. Fraud and Abuse by Users

Fraudulent or abusive acts are forbidden, including:

• Use of stolen or unapproved payment methods;
• Unjustified chargebacks or payment disputes;
• Abuse of Platform systems or promos;
• Creating accounts to avoid enforcement.

The Company can investigate and enforce penalties, including suspensions and reporting.

25. Privacy and Respect for Others

You must respect other Users’ privacy and rights by not:

• Recording or sharing content without permission;
• Disclosing personal info of others;
• Engaging in stalking, doxxing, or harassment.

Violations can lead to legal action.

26. Enforcement and Consequences

The Company may take enforcement steps against rule-breakers, including:

• Warnings;
• Temporary suspensions;
• Permanent account closure;
• Financial restrictions;
• Content removal.

Enforcement is at the Company’s discretion and can happen without notice when needed.

27. User Acknowledgment

By using the Platform, you accept responsibility for your conduct and agree to follow all rules.

Non-compliance can lead to loss of access and enforcement actions.

28. Performers — General Role

Performers are Users who create and share content on the Platform.

Performers work independently and are fully responsible for their content, behaviour, and legal compliance.

The Company does not employ or manage Performers.

29. Independent Contractor Status

Performers acknowledge they are independent contractors, not employees or agents of the Company.

The Company does not control how Performers create or deliver content.

Performers set their own schedules and styles, within this Agreement’s rules.

30. Performer Responsibilities

Performers must:

• Ensure their content complies with laws;
• Verify age and identity for themselves and any participants;
• Keep required documents and records;
• Meet tax, financial, and legal duties;
• Ensure all content is consensual and lawful.

The Company is not liable for Performers’ failures to comply.

31. Content Standards and Restrictions

Performers must not create or share content that:

• Involves minors or banned persons;
• Breaks laws;
• Is non-consensual or exploitative;
• Violates intellectual property rights;
• Breaches Platform rules.

The Company may remove or restrict violating content.

32. Earnings and Payments to Performers

Performers can earn from User interactions like tips, private chats, subscriptions, and other monetized features.

Earnings depend on Platform systems and policies.

Note:

• No guaranteed income;
• Earnings vary with User engagement;
• Fees or commissions may be deducted.

Payments require verification and legal compliance.

33. Payment Adjustments and Withholding

The Company may adjust or withhold earnings if:

• Fraud is suspected;
• Chargebacks occur;
• Agreement breaches are found;
• Legal requirements apply.

These protect the Platform’s financial integrity.

34. No Guarantees and Platform Limitation

The Company does not guarantee:

• Uninterrupted service;
• Specific earnings;
• User engagement levels.

Performers accept risks linked to digital services and user interactions.

35. Prohibited Performer Conduct

Performers must not:

• Engage in illegal or banned acts;
• Falsify identity or age;
• Use undisclosed third parties to perform;
• Violate intellectual property;
• Bypass Platform systems or rules.

Violations may cause immediate account termination.

36. Record-Keeping and Compliance

Performers alone keep required records, like age verification and consent, as per laws such as 18 U.S.C. § 2257 and equivalents.

The Company doesn’t hold or manage these records.

37. Taxes and Financial Responsibility

Performers are fully responsible for taxes and reporting from their activities.

The Company isn’t liable for tax matters unless legally required.

38. Suspension and Termination of Performers

The Company may suspend or terminate Performer accounts for breaches or legal issues, with or without notice.

39. Performer Acknowledgment

By performing on the Platform, you accept full responsibility and agree to follow all laws and this Agreement.

40. Studios — General Role

A Studio is any individual or business managing or representing one or more Performers ("Studio Models") on the Platform.

Studios operate independently, handling their own business and compliance.

The Company doesn’t manage or control Studios or their Performers.

41. Independent Contractor Status

Studios acknowledge they are independent contractors, not Company employees or agents.

The Company does not oversee Studio operations or employment.

Studios carry full responsibility and risks.

42. Responsibility for Studio Models

Studios are responsible for all individuals under their accounts, including:

• Verifying age and identity;
• Ensuring legal age compliance;
• Obtaining valid consent and contracts;
• Following labor, tax, and content laws;
• Monitoring conduct and compliance.

The Company has no contracts with Studio Models and isn’t liable for their actions.

43. Studio Model Agreements

Relationships between Studios and Studio Models are governed by separate contracts.

The Company isn’t party to these and isn’t liable for disputes.

Studios must ensure contracts follow laws and don’t conflict with this Agreement.

44. Content Responsibility

Studios are responsible for content produced or shared via their accounts, including:

• Live and recorded shows;
• Compliance with adult content laws;
• Avoiding illegal or prohibited material;
• Respecting intellectual property.

The Company doesn’t monitor all content and isn’t responsible for Studio content.

45. Payments and Earnings

Studios may earn via Studio Models’ activities.

Earnings are calculated by Platform policies.

Note:

• No guaranteed earnings;
• Studios handle payments to Models;
• The Company isn’t responsible for disputes between Studios and Models.

46. Payment Adjustments and Risk Controls

The Company may adjust or withhold earnings if:

• Fraud is suspected;
• Disputes or chargebacks happen;
• Agreement violations are found;
• Legal rules apply.

These actions protect the Platform’s financial integrity.

47. Legal and Regulatory Compliance

Studios must comply with all laws where they operate or their content is accessible, including:

• Age verification and records;
• Tax and financial duties;
• Labor laws;
• Content and broadcast regulations.

Complying in one region doesn’t exempt obligations elsewhere.

48. No Control by the Company

The Company doesn’t control Studio activities or content timing.

Studios are fully responsible for compliance.

49. Fraud and Abuse Prevention

Studios must not:

• Artificially boost activity or earnings;
• Coordinate fraudulent payments;
• Use unauthorized payment methods;
• Exploit Platform systems.

Violations may lead to enforcement including account termination.

50. Indemnification

Studios agree to protect the Company from claims arising from:

• Their actions or those of Studio Models;
• Legal violations;
• Agreement breaches;
• Content shared through Studio accounts.

51. Suspension and Termination

The Company may suspend or terminate Studio accounts for breaches or illegal activities, with or without notice.

52. Studio Acknowledgment

By operating as a Studio, you accept responsibility for all activities under your account and agree to comply with laws and this Agreement.

53. User-Generated Content

The Platform lets Users, including Performers and Studios, create, upload, and distribute content ("Content").

All Content is independently produced by Users; the Company does not create it.

Users are solely responsible for their Content.

54. Ownership of Content

Users keep full ownership rights over their Content.

Nothing here transfers Content ownership to the Company.

Users must have rights and permissions to use and share their Content.

55. License Grant to the Company

By sharing Content, you grant the Company a worldwide, royalty-free license to host, store, broadcast, display, reproduce, and distribute it to operate and promote the Platform.

This includes:

• Streaming and showing Content to Users;
• Displaying Content across the Platform;
• Using Content for marketing;
• Adapting Content for technical needs.

This license doesn’t transfer ownership and is limited to Platform operation and promotion.

56. User Representations and Warranties

You warrant that:

• You own or have rights to the Content;
• Content is lawful;
• All people in Content consented;
• All participants are adults;
• Content doesn’t infringe third-party rights.

You accept full liability for breaches.

57. Prohibited Content

You must not upload or share Content that:

• Involves minors or illegal acts;
• Is non-consensual or exploitative;
• Violates intellectual property;
• Is fraudulent or misleading;
• Breaks laws or Platform rules.

The Company may remove or restrict such Content without notice.

58. Monitoring and Moderation

The Company doesn’t monitor all Content actively but may review and remove Content at its discretion.

It’s not liable for failing to monitor everything.

Content violating laws or this Agreement may be removed or restricted.

59. Intellectual Property Rights of the Platform

All intellectual property related to the Platform, including software, design, and branding, belongs to the Company or its licensors.

Users get a limited, non-transferable license to use the Platform.

Copying or exploiting Platform parts without permission is forbidden.

60. Content Removal and Enforcement

The Company can remove or restrict access to Content violating this Agreement or laws without prior notice.

Removal doesn’t imply legal liability.

61. Repeat Violations

Users repeatedly breaking rules may face escalating penalties, including permanent ban.

Enforcement decisions are at the Company’s sole discretion.

62. Content Indemnification

Users agree to protect the Company from claims related to their Content, including IP infringement, privacy breaches, or illegal material.

63. Payments Overview

The Platform offers payment features allowing Users to buy credits or paid services and lets Performers and Studios earn money.

All payments go through third-party providers; the Company isn’t a bank.

All transactions relate to digital services, not physical goods.

64. Credit System

The Platform may use credits Users buy to access services or interact with Performers.

Credits have no cash value outside the Platform and can’t be transferred.

Credits are not redeemable for cash except where the law requires.

65. Payment Methods

Supported payment options include credit cards, digital wallets, and alternative systems.

Payments are subject to verification by payment providers.

The Company is not responsible for declined or failed payments.

66. Transaction Finality

All purchases are final once processed.

By completing a transaction, you acknowledge the service is delivered immediately and can’t be reversed.

This covers digital content, live interactions, and subscriptions.

67. Refund Policy

Refunds are generally not given after service access.

Refunds may be made only for:

• Unauthorised transactions;
• Duplicate charges;
• Technical failures leading to non-delivery.

Refunds aren’t given for:

• Dissatisfaction;
• Failure to cancel subscriptions;
• Completed services;
• User error or voluntary buys.

68. Subscriptions and Recurring Billing

The Platform may offer automatically renewing subscriptions.

You must cancel before renewal to avoid charges.

No refunds for renewals if cancellation isn’t done in time.

69. Live Services and Interaction Risks

Live services can be affected by tech issues, connection drops, or user actions.

Note:

• Temporary interruptions don’t automatically qualify for refunds;
• No guarantee of uninterrupted streams;
• You accept risks of live digital interactions.

70. Tips and Voluntary Payments

Tips are optional payments from Users to Performers.

All tips are final and non-refundable.

Tips don’t guarantee any specific Performer action or content.

71. Chargebacks and Disputes

You agree not to dispute valid transactions.

Chargebacks without valid reason breach this Agreement.

The Company may contest chargebacks, suspend or close accounts, and seek cost recovery where legal.

72. Fraud Prevention

The Company uses systems to detect and block fraud or suspicious activity.

By using the Platform, you consent to monitoring.

High-risk transactions may be blocked.

73. Payment Adjustments

The Company may adjust or reverse payments if:

• Fraud suspected;
• Chargebacks occur;
• Errors found;
• Legal obligations require.

Such adjustments affect balances and earnings.

74. Currency and Fees

Transactions may involve currency conversion and fees by payment providers.

The Company doesn’t control these rates or fees.

You’re responsible for reviewing transaction details before payment.

75. Taxes and Financial Responsibility

Users, Performers, and Studios handle taxes and financial obligations from Platform transactions.

The Company isn’t responsible for tax reporting or payments unless legally required.

76. Payment Enforcement

The Company may act against payment-related abuse, including fraud or Agreement breaches.

Actions include suspension, termination, or financial restrictions.

77. Platform Rules and Compliance

All Users, including Viewers, Performers, and Studios, must obey this Agreement and laws.

The Platform takes a zero-tolerance stance on illegal acts, exploitation, and abuse.

You’re solely responsible for ensuring your conduct complies with laws and regulations.

78. Violations of the Agreement

A violation happens if you break this Agreement, laws, or Platform rules.

Examples include:

• Submission of illegal or banned content;
• Fraud or abusive acts;
• Payment system violations;
• Bypassing Platform protections;
• Harassment or abuse.

79. Enforcement Actions

The Company may respond to violations with:

• Warnings;
• Content removal;

Actions can be immediate and without notice to protect the Platform.

80. Discretion and Case-by-Case Assessment

Enforcement isn’t required to be uniform.

81. No Fixed Penalty Structure

The Platform doesn’t use fixed fines or penalties.

Mandatory local laws override this Agreement only where required and don’t affect other terms.

98. Limitation of Liability

To the fullest legal extent, the Company isn’t liable for indirect, incidental, consequential, special, or punitive damages from using the Platform.

• Loss from User interactions or content;
• Technical failures or outages.

The Company’s total liability is capped at amounts you paid, if applicable.

You assume all risks from using the Platform.

100. Indemnification

This Agreement is the definitive legal document governing your relationship with the Company.

The Company reserves all rights not expressly granted and will enforce this Agreement to the fullest extent allowed by law.
